Re:

TACA BAF Update

Dear NASA Member:

THE TRANS-ATLANTIC CONFERENCE AGREEMENT (TACA) announces:

The Shipping public will be aware that the escalating price of fuel, particularly over the past eight months, has affected all Parties through increased costs and/or associated tariff charges. In assessing the Bunker Adjustment Factor TACA has continued to follow procedures in keeping with the long established bunker formula. However, notwithstanding insufficient returns, coupled with increased costs, it has become apparent to the TACA Parties that the most recent increases in the price of fuel have created a situation believed to be untenable in today’s market.

The TACA Parties, therefore, wish to advise their customers that the bunker formula will be suspended, temporarily, and the current BAF will be adjusted, with immediate effect, to the levels published and in effect on September 16, 2007. These levels will remain effective through, at least, February 15th, 2008 as follows:

Traffic to/from and via:

Atlantic/Gulf Coast Ports   Pacific Coast Ports
$ 607 per 20ft container   $911 per 20ft container
$1214 per 40/45ft container   $1822 per 40/45ft container
WM $61.00   WM $91.00

The TACA BAF to apply from February 16th, 2008, will be announced

no later than January 15th, 2008. Such will be published in TACA’s relevant tariffs and on its website.

For and on behalf of the following TACA Parties:

Atlantic Container Line A.B.
Maersk Line
Mediterranean Shipping Co.
Nippon Yusen Kaisha (NYK) Line
Orient Overseas Container Line
